I'm pleased to inform all our members that the letter sent by NYSPA President, Anita Morck, to Governor George Pataki was instrumental in defeating Assembly bill number 3039. The bill would have amended the Vehicle and Traffic Law to enforce the payment within thirty days of all refunds after an appeal. A refund within thirty days was not as much a problem as part two of the bill, which would impose a penalty against the bureau if any refunds were not paid within 30 days. The penalty would accrue at the same rate as the penalty schedule on a parking fine. Most Courts and Administrative Tribunals apply refund money to any outstanding fines before returning funds. The Governor signed his veto on September 22, 2003.
